CB.8:7 - Conformance Checklist

For the present rule or case, ask:

  • Can a participant understand what to do and obtain the relevant guidance at the point of participation?
  • Does the concern have an accessible receiver with the capability and authority for the next action?
  • Are observed conduct, reported experience, interpretation and unresolved facts kept distinct?
  • Is any temporary protection limited and subject to a real next review?
  • Does the selected response address the actual difficulty, and has it taken effect?
  • Can the affected person obtain an intelligible reason and a reachable, suitably independent review?
  • Has an error been corrected in the access, material or understanding it changed?

Routine recognition can be brief. The evidence, hearing and review needed for a consequential restriction depend on its actual consequences and governing arrangement.
