PSD.14:4.4 - Establish a viable observation and return arrangement
Name who will observe, who will interpret, who receives the qualified result and who owns any resulting decision. Establish the assignments, capability, access, resources, timing and protection needed for those particular contributions. Several functions may be carried by one performer where suitable; distinguish them when competence, independence, workload or authority makes that difference material.
State what happens if the observer cannot obtain the evidence, the source becomes unavailable, the interpreting owner changes, or the evidence arrives too late. A failed observation is not a favourable observation. Return the gap and its effect on current reliance to the named receiver; use any existing authorized escalation or protection rule when it applies.
Where an actual professional service exists, fit contact, confidentiality, referral and closure to that service’s conditions. The NCDA 2024 Code, A.10 and B.1, for example, constrains continuity and information sharing in career services; it creates no AI-holder duty or universal follow-up contract.
Before relying on the arrangement, test the decisive connection at proportionate cost: can an example material observation be obtained, qualified, delivered and understood as the named reopen question in time? A prospective walkthrough can expose an assignment or interpretation gap; it proves neither later enactment nor empirical effectiveness. Use stronger domain validation when the consequence requires it.
Record whether the result is a proposed arrangement with conditions, an established arrangement ready for its bounded use, or a blocker. Do not promise observation that has no capable performer or permitted source. State the closing or review condition for the arrangement so that a bounded recommendation does not create indefinite unowned monitoring.
